Terms of Service

1. Acceptance and scope

By creating an account, accessing the website, or using any Fotoly workflow, you agree to these Terms and our published Privacy Policy and Refund Policy.

If you are using the service on behalf of a business, you confirm that you have authority to bind that business to these Terms.

2. Service delivery

Fotoly is delivered entirely as a digital web-based service. No physical goods are shipped. Access is granted through your account after registration or successful payment.

Available workflows may include background removal, transparent PNG output, scene generation, image enhancement, multi-angle generation, and batch processing. Processing times vary based on the selected features and system load.

3. Accounts, subscriptions, and credits

• You must provide accurate account information and keep your login credentials secure.
• Paid plans may be billed monthly, quarterly, or yearly. Cancelling an auto-renew subscription stops future renewals and takes effect at the end of the current paid term.
• Included usage credits are allocated monthly according to your plan. Quarterly and yearly plans still receive their included credits in monthly allotments, and unused credits do not roll over unless we explicitly state otherwise in writing.
• Some plan terms may be sold as prepaid manual-renew purchases. Those plans do not renew automatically and may display different payment methods depending on customer region and processor support.

4. Acceptable use and anti-fraud rules

• Do not upload unlawful, infringing, deceptive, hateful, or otherwise prohibited content.
• Do not use Fotoly to create misleading listings, counterfeit product imagery, or imagery that violates marketplace or advertising rules.
• Do not interfere with the service, abuse rate limits, attempt unauthorized access, or use automation in ways that harm the platform or other users.

5. Intellectual property and content rights

You keep ownership of the images and other content you upload. You grant Fotoly a limited license to host, process, transform, and transmit that content only as needed to operate the service.

You are responsible for ensuring that you have the rights and permissions needed to use uploaded assets and any resulting commercial outputs.

6. Accuracy, compliance, and no approval guarantee

Fotoly may provide image checks, platform recommendations, or workflow suggestions, but you remain responsible for reviewing final assets before publishing them to any marketplace or ad platform.

We do not guarantee that any image, listing, or marketing asset will be approved by Amazon, Shopify, Etsy, TikTok Shop, Taobao/Tmall, Instagram Shop, payment providers, or any other third party.

7. Suspension and termination

We may suspend, restrict, or terminate access if we reasonably believe an account is being used fraudulently, unlawfully, abusively, or in violation of these Terms.

You may stop using the service at any time. Any active paid subscription remains governed by the billing terms described above.

8. Liability and governing law

To the maximum extent permitted by law, Fotoly is provided on an “as available” basis, without guarantees of uninterrupted operation or perfect output quality.

These Terms are governed by the laws that apply at the operator’s registered office, except where mandatory consumer protection law requires otherwise. Any dispute should first be raised with our support team in good faith.

9. Updates to these Terms

We may update these Terms from time to time. Material changes will be reflected on this page, and continued use of the service after the effective date means you accept the updated Terms.
